| 本文从《中华人民共和国保险法》出发介绍了环境污染责任保险的特点，从环境权理论、无过错责任理论、侵权责任社会化理论和风险可保性理论四个方面，厘清了环境污染责任保险的理论基础；阐述了国外的发展历程以及国内的发展现状，分析了环境污染责任保险在我国发展存在的问题，提出了可以通过专项课题研究解决环境污染责任保险发展道路上的政策和技术难题，采取稳步推进、扩大承保面、政府支持和市场竞争等方式完善环境污染责任保险，为国内日益严重的企业环境风险问题提供绿色金融方面的解决方案，缓解社会矛盾，减轻政府的管理压力。 |

| According to the Insurance Law, this paper describes the characteristics of Environmental Pollution Liability Insurance (EPLI), and clarifies the theoretical foundation of EPLI from four aspects, which are Environmental Rights Theory, No-fault Liability Theory, Tort Socialization Theory and Insurable Risk Theory. It also introduces the development process and condition in China and other countries, analyzes the existing problems of EPLI development in China, and then brings forward the corresponding measures based on the development situations of EPLI in China. Improve the current EPLI via extending insurance coverage, government support and market competition, and then provide green finance solutions for the growing domestic enterprises environmental risk problem, ease social contradictions, reduce the pressure of the government's management |
